Sec. 38-5. - Open burning of yard waste.
(a) Burn days. It shall be lawful to burn landscape waste on Mondays, Tuesdays, Wednesdays, Thursdays, Fridays and Saturdays. Landscape wastes are defined as grass, shrubbery, leaves, tree limbs and all other vegetation.
(b) Hours of burning. It shall be lawful to burn landscape wastes from between the hours of 8:00a.m. and sunset on the burn days set out in subsection (a) of this section.
(c) Boundary limitations. The burning of landscape wastes shall not be conducted within 15 feet of any structure.
(d) Burning on public streets and sidewalks. Burning of landscape wastes is forbidden on any city street, alley, sidewalk or avenue, as set out in section 42-38 and in chapter 78 pertaining to streets, sidewalks and other public places.
(e) Attendance of open fires. When burning landscape wastes all fires shall be attended by a competent person until such fires are extinguished. The person attending such fire shall have a garden hose connected to a working water supply or other fire extinguishing equipment readily available for use as long as the fire has not been extinguished.
(f) Fire chief. The fire chief may prohibit any or all such fires when atmospheric conditions or other local circumstances make such fires hazardous. Prohibitive burning shall be communicated by a dedicated phone line. The dedicated phone line shall be maintained and housed by, and at the fire department. Residents should call before burn.
(g) Complaints. The police department will handle all complaints regarding such fires. The minimum fine shall be $50.00, and the maximum fine shall be $500.00.
